Marketplace terms & conditions
These terms govern access to the ZAVYNE marketplace, enquiries, booking requests and concierge arrangements. They are written for the pre-launch service and must be accepted before a paid booking.
This is a substantive operational draft, not legal advice. Spanish consumer, travel, maritime, aviation, tax and data-protection counsel must approve the final contracting entity and jurisdiction clauses before ZAVYNE accepts payments.
1. The marketplace
ZAVYNE is a curated marketplace connecting guests with independent owners, property managers, charter operators, brokers, fleet providers and experience suppliers (“Partners”). Unless a booking confirmation expressly says otherwise, the Partner—not ZAVYNE—supplies the accommodation, vessel, aircraft, vehicle or experience.
Listings are invitations to enquire. Availability and price are not final until the guest receives and accepts a written booking confirmation and cost breakdown.
2. Eligibility and accounts
You must be at least 18 and able to enter a binding contract. Certain categories impose higher minimum ages, licence requirements, passenger declarations or identity checks. Account information must be accurate and kept private.
A guest booking for others must have authority to provide their information and remains responsible for communicating the confirmed terms to the travelling party.
3. Requests, quotes and payment
Instant Book, Request to Book and Request a Quote are distinct. A request or quote does not create a confirmed booking until acceptance, required verification and payment steps shown in the confirmation are complete.
The final breakdown identifies the Partner price, taxes, security deposit, mandatory charges and variable items such as fuel, berthing, catering, airport charges or yacht Advance Provisioning Allowance (APA). No charge is taken merely for submitting an enquiry.
4. Changes and cancellation
The cancellation policy shown in the accepted confirmation applies. If a Partner cancels, ZAVYNE will help seek a comparable alternative or arrange the refund due under the confirmation, but availability of a replacement is not guaranteed.
Weather, air-traffic restrictions, port authority decisions, sea state and other safety matters may require delay, rerouting or cancellation. Category-specific operator rules and applicable passenger rights continue to apply.
5. Guest responsibilities
Guests must follow property rules, captain and crew directions, operator safety instructions, licence and age requirements, capacity limits, pet rules and local law. Guests are responsible for damage caused by them or their party, subject to evidence and the agreed deposit process.
Prohibited conduct includes unlawful use, unsafe behaviour, unauthorised events or subletting, harassment, circumvention of agreed platform payments, and misleading identity or booking information.
6. Safety, insurance and risk
Partners must hold the licences, operating authority and insurance required for their category. ZAVYNE reviews evidence but does not guarantee that every risk is eliminated. Guests should obtain appropriate travel, medical and cancellation insurance.
Aviation is supplied only through appropriately authorised operators or brokers acting with disclosed authority. Yacht charters remain subject to the captain’s overriding safety decisions.
7. Liability
Nothing excludes liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence where applicable. Subject to that limit, each Partner is responsible for performing its confirmed service, and ZAVYNE is responsible for its own marketplace and concierge services.
Final limitations, governing law, dispute venue, consumer cancellation rights and the identity of the contracting ZAVYNE entity will be inserted following Spanish and cross-border counsel review before payments are enabled.
